ABOUT THESE TERMS
These Terms of Use govern your access to and use of the Your Growing Companion application and its related services.
By creating an account or using the app, you agree to these terms. If you do not agree, you should not use the app.
These terms should be read together with our Privacy Policy and Subscription and Cancellation Policy.

WHO MAY USE THE APP
You must be at least 18 years old to purchase a paid subscription.
If you are under 18, you may use the app only with the permission and supervision of a parent or legal guardian.
You must be legally capable of agreeing to these terms or have the agreement of a parent or legal guardian acting on your behalf.
YOUR ACCOUNT
You must provide accurate and current information when creating and maintaining your account.
You are responsible for keeping your login details secure and for activity carried out through your account.
You must notify us promptly if you believe your account has been accessed without permission.
You must not create an account using another person’s identity or allow another person to use your account in a way that breaches these terms.
FREE ACCESS AND PAID FEATURES
The app provides free access to selected features, including the sowing calendar and cold-weather alerts.
New users may receive a 14-day trial of additional features. After the trial, those additional features require a paid yearly subscription.
Prices, automatic renewal, cancellations and refunds are explained in our Subscription and Cancellation Policy.
PURPOSE OF THE APP
Your Growing Companion provides tools to help users plan, record and manage gardening activities.
Features may include sowing information, weather alerts, growing-space planning, crop and planting records, harvest records, garden photographs, reminders, suggestions, achievements, projects and gardening assistance.
Features may be added, changed or withdrawn as the app develops. We will act reasonably when making changes that materially affect an active paid subscription.
GARDENING INFORMATION
Information supplied through the app is for general gardening and educational purposes.
Recommendations may be based on the location, weather information, dates, crop information and other details available to the app. Local conditions, soils, microclimates, pests, varieties and growing methods vary, so results cannot be guaranteed.
You remain responsible for deciding whether any suggestion is appropriate for your garden and circumstances.
Always follow product labels, manufacturers’ instructions and local laws when using tools, fertilisers, treatments or pest-control products.
WEATHER AND COLD-WEATHER ALERTS
Weather forecasts and alerts rely on information supplied by third-party weather services and on the location information available to the app.
Forecasts can change and may be delayed, incomplete or inaccurate. Local conditions within a garden may differ from the reported forecast.
Cold-weather and frost alerts are provided as a helpful guide only. You should not rely on the app as your sole source of weather or safety information.
We cannot guarantee that an alert will be sent, received or acted upon before a weather event.
SOWING CALENDAR
The sowing calendar provides general guidance based on available location, climate and crop information.
Suggested sowing dates are not guarantees. You should consider your own local conditions, recent weather, soil temperature, available protection and experience before sowing or planting.
AUTOMATED AND AI-ASSISTED FEATURES
Some app features may use automated systems or artificial intelligence to provide gardening suggestions, answer questions or help identify plants, insects or plant-health problems.
Automated results can be incomplete or incorrect and should be treated as guidance rather than a definite identification or professional diagnosis.
Do not rely solely on an automated result when deciding whether to eat a plant or fungus, handle an insect, use a treatment, or take action that could affect people, animals or the environment.
INFORMATION YOU ADD TO THE APP
You may add information such as growing-space details, crop records, notes, harvest records, photographs and project information.
You retain ownership of the original content and information you add.
You give us a limited permission to store, process, copy and display that content only as reasonably necessary to operate, maintain, secure and improve the app and provide its features to you.
You confirm that you have the right to upload any content you provide and that it does not infringe another person’s rights.
Our handling of personal information is explained in our Privacy Policy.
ACCEPTABLE USE
You must not:
Use the app for unlawful, fraudulent or harmful purposes.
Upload malicious code, viruses or other harmful material.
Attempt to gain unauthorised access to the app, another user’s account, our servers or connected systems.
Interfere with the security, operation or performance of the app.
Copy, reverse-engineer, scrape or extract the app or its data except where applicable law expressly permits it.
Use automated systems to place an unreasonable load on the service.
Upload content that is unlawful, threatening, abusive, defamatory, discriminatory, obscene or infringes another person’s rights.
Use the app or its outputs to mislead, impersonate another person or cause harm.
INTELLECTUAL PROPERTY
The app, its design, software, branding, databases, original text, graphics and other materials are owned by or licensed to Tanya 779 Limited and are protected by intellectual-property laws.
We give you a limited, personal, non-exclusive, non-transferable and revocable right to use the app in accordance with these terms.
No ownership rights in the app or our intellectual property are transferred to you.
THIRD-PARTY SERVICES
The app may rely on or connect to third-party services, including hosting, payment processing, weather data, mapping, location, email, artificial-intelligence and communication providers.
Third-party services may have their own terms and privacy policies.
We are not responsible for third-party services or for disruption caused by circumstances outside our reasonable control, but this does not affect any responsibility we cannot legally exclude.
AVAILABILITY AND UPDATES
We aim to provide a reliable service, but we cannot guarantee that the app will always be available, uninterrupted, secure or free from errors.
We may temporarily suspend access for maintenance, updates, security or technical reasons.
You may need to use a supported browser, device or software version to access some features.
SUSPENDING OR CLOSING ACCOUNTS
You may stop using the app at any time and may request closure of your account.
Cancelling a paid subscription and closing an account are separate actions. Closing an account does not necessarily create a refund entitlement.
We may suspend or close an account where we reasonably believe these terms have been seriously or repeatedly breached, the account poses a security risk, payment is overdue, or suspension is required by law.
Where appropriate, we will give reasonable notice and an opportunity to correct the problem.
LIMITATION OF LIABILITY
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
The app is intended primarily for personal and domestic gardening use.
To the fullest extent permitted by law, we are not responsible for loss or damage caused by reasonable reliance on general gardening guidance, inaccurate third-party information, unavailable alerts, or circumstances outside our reasonable control.
We are not responsible for business losses, loss of profits, loss of opportunity or indirect or consequential loss arising from personal use of the app.
Your statutory rights as a consumer are not affected.
CHANGES TO THESE TERMS
We may update these terms to reflect changes to the app, our business, technology or legal obligations.
The updated terms will be published with a revised “Last updated” date. Where a change materially affects users, we will provide reasonable notice where required.
Continued use of the app after updated terms take effect means that the new terms will apply.
GOVERNING LAW
These terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory protections provided by the law of the country in which you live and may be entitled to bring proceedings in your local courts.
